2025 Red Stag Rotorua Marathon Terms and Conditions – 3 May 2025

1.These Terms & Conditions (“Terms”) apply to your entrance into the 2025 Red Stag Rotorua Marathon and associated events (“Event”) on 3 May 2025. By entering the Event and paying the applicable entry fee, you will be deemed to have accepted these Terms.    

2. Age:  The minimum age for the 5km is 10 years of age. The minimum age for the 12km is 14 years of age. The minimum age for the Half Marathon is 16 years of age and the minimum age for the Marathon is 18 years of age. All ages are taken on the day of the event.  With the exception of the NZ Championship event for the 5km which is as of 31 Dec 2025.  

3. Transfer your entry to another event distance or category:   

Your accepted entry can be transferred to another distance, or category up until 11.59am (NZ Time) Tuesday 29 April 2025 via the online registration portal. All transfers will incur a $20 fee. Transfers to a longer distance will also be required to pay the fee difference from the original event to the new event at current event price as of the date of the transfer. Transfers to a shorter distance will be refunded the difference from the original event price to the new event at current event prices as of the date of transfer, minus the transfer fee. After Tuesday 29 April 2025 (4 days before event day) all distance or category transfers must be done in person at registration. Transfers do not apply to future years, or if the new entrant is ineligible for an event due to age criteria for that event.  

4. Transfer your entry to someone else: your accepted entry can be transferred to someone else in accordance with the following:    

  • Person to Person transfers accepted up until 11.59am (NZ Time) on Tuesday 29 April 2025 via the online registration portal. No Person to Person transfers will be accepted after this date.   

  • A transfer fee of $20NZD including GST will be charged to the withdrawing entrant irrespective of event distance.   

  • Entrants can only transfer their entry to someone else within the same distance event already entered.   

  • Merchandise purchases paid for at the time of entry by the original person entering (if any) which are paid by the Event Owner to a third-party are non-refundable as are donations made. Merchandise will be at event registration for collection or can be sent out to the original person entering with courier track and trace at the cost to that person. 

  • It is not possible to transfer your entry to someone else who is wanting to do a different distance event (i.e. Full Marathon to Half Marathon).   

  • To transfer an entry to someone else, the initial registrant must log in to the online registration system (Race Roster), select ‘Transfer Registration’ and follow the necessary steps. Please note: the receiving athlete will be sent a link to complete the registration. 

5. Withdrawals:  

If you cannot participate in the event for any reason, entry fee refunds are available in accordance with the below stated Participant Withdrawal dates only. After the stipulated dates, entry fees are non-refundable for withdrawals initiated by the athlete. Requests for refunds must be notified to the organiser in writing via email at marathon@athletics.org.nz  

Refund protection can be purchased during registration via the Race Roster Enhanced Refund Protection Program.  

Participant withdrawal dates:  

a. Entry fee refunds requested up until 11.59pm on Thursday 19 December 2024 will receive a refund of 75% of their entry fee.  

b. Entry fee refunds requested from 12.00am Sunday 22 December 2024 up until 11.59pm on Saturday 8 February 2025 will receive a refund of 50% of their entry fee.  

c. Entry fee refunds requested from 12.00am Sunday 9 February 2025 to 11.59pm Saturday 22 March 2022 will receive a refund of 25% of their entry fee.  

Please note: This event takes place in Rotorua, New Zealand. It is each athlete’s sole responsibility to ensure that they can attend (including Event Pack Collection during specified times) and participate in the event on the day. Other than as provided for in the Participant Withdrawal policy set out above, no further remedies will be provided for change of mind, change of personal circumstances (including work conflicts), or injury.   

Event Organiser reserves the right to request additional verification of the relevant circumstances and may deny a refund request if the documentation provided is deemed insufficient.  

Requests for refunds must be communicated to the organiser via marathon@athletics.org.nz before the closing dates above. Athletics New Zealand will process refunds within 5 working days, the payment will then take approximately 3 – 7 working days to arrive in the recipients bank account.  

6. Cancellation: In the case of total cancellation of the Event due to an event of force majeure the total entry fee is non-refundable. The exception to this is you have purchased Race Roster Enhanced Refund Protection Program you may be covered. Please check the terms and conditions of the Refund protection program.  

For the purposes of this clause, an event of force majeure means any event or circumstances beyond the reasonable control of Athletics New Zealand, including without limitation, fire, flood, explosion, earthquake, storm or other natural disaster, civil commotion, hostilities (whether war is declared or not), sabotage, terrorist attack, or the acts or decisions of any governmental, public or judicial authority or the imposition of any independent government sanction or similar action made after the date of these Terms. Athletics New Zealand will not be liable for its inability or failure to perform, or delay in performing, any of its obligations under these Terms or in relation to the Event where this is caused by an event of force majeure.  

7. The parties agree and acknowledge that cancellation of the event for any reason (including due to an event of force majeure) will not constitute impossibility of performance or frustration of these Terms and that in such circumstances, clauses 5 and 6 (as relevant) will apply instead of Subpart 4 of the Contract and Commercial Law Act 2017.  

8. Discount Codes: Only one discount code can be used per entry. If a participant is eligible for more than one discount code, the discount code with the highest value will apply. Discount codes for Athletics New Zealand competitive members, Survivors Club members, students (with valid tertiary education ID) and Seniors (with proof of age ID) can be requested by emailing marathon@athletics.org.nz.

9. Athletics NZ (and their officers, directors, volunteers, employees, sponsors or any party associated with the event) will not be liable to you under the law of tort (including negligence), contract or otherwise for any direct or indirect loss, injury or death which might be sustained by you or any other party directly or indirectly associated with you, from your intended or actual participation in the event and its related activities.  

10. Nothing in these Terms is intended to limit or exclude Athletics New Zealand’s liability of your rights if you are a consumer for the purposes of the Consumer Guarantees Act 1993 or the Fair Trading Act 1986.  

11. I authorise Athletics New Zealand to use my name, voice or picture in any broadcast, telecast, advertising, promotion or in any other way relating to the Event pursuant to the Privacy Act 1993. ANZ will comply with its obligations under the Privacy Act 1993 and the Privacy Act 2020 in relation to the collection, use, and disclosure of any personal information obtained from you in connection with your entrance into the Event.  

12. Athletics New Zealand is committed to ensuring that all competitors compete on a level playing field.  By entering and competing at the Event, you and your support personnel are agreeing to be bound, and to abide by, Athletics New Zealand’s rules and regulations, including the World Anti-Doping Agency Code, and that competitors may be tested at any time, to which they consent. Failure to comply with these requirements may result in action being taken against you and / or support personnel in accordance with these terms and conditions and / or those rules, regulations and / or code, which may include refusal of entry or disqualification from the Event.  To understand more about anti-doping, the rules, and your responsibilities, please read the Athletics New Zealand Integrity Regulations.  

13. I acknowledge that Athletics New Zealand have absolute discretion in accepting my entry, which may be revoked at any time.  

14. I have read and agree to all the safety information, rules, and conditions above and on the accompanying pages.  

15. The Rotorua Marathon is an Athletics New Zealand event. Athletics New Zealand is committed to protecting the privacy of your personal information.  These Terms and Conditions should be read alongside the Athletics New Zealand Privacy Policy, which is available to view here. We only use your personal information to deliver you a service or perform other necessary business functions and activities relating to the Rotorua Marathon. You may opt not to provide us with your personal information; however, please note, without this personal information we may not be able to provide you with some of the services and/or products you are seeking.  

16. Amendments: The event organizers reserve the right to amend or update these Terms and Conditions at any time without prior notice. Any changes will be effective immediately upon posting on the official Rotorua Marathon website. Participants are encouraged to regularly review the website for any updates. Continued participation in the event after such changes have been posted constitutes acceptance of the revised Terms and Conditions.
